Welcome to Nieslanik Beef. These Terms and Conditions ("Terms") govern your use of our website, products, and services, including the purchase of beef and related products from our ranch located in Carbondale, Colorado. By placing an order, visiting our website, or otherwise engaging with Nieslanik Beef, you agree to be bound by these Terms.

1. About Us

Nieslanik Beef is a family-owned cattle ranch based in Carbondale, Colorado, raising and selling grass-fed/grass-finished (or as applicable) beef directly to consumers. References to "we," "us," or "our" refer to Nieslanik Beef; "you" refers to the customer.

2. Products and Availability

  • All beef is raised, processed, and sold subject to seasonal availability. Cuts, quantities, and bundle contents may vary based on the animal and current inventory.

  • Product weights are approximate. Final weight and price may vary slightly from what is listed at the time of order, particularly for bulk/bundle orders (quarter, half, or whole beef).

  • We reserve the right to substitute comparable cuts if a specific item becomes unavailable, and will notify you when possible.

3. Ordering and Payment

  • Orders may be placed online, by phone, email, or in person, as offered.

  • Full or partial payment (deposit) may be required at the time of order, with the balance due upon pickup or delivery, depending on the order type (especially for bulk beef orders).

  • We accept the payment methods listed at checkout or communicated directly to you. All prices are in U.S. dollars and do not include applicable sales tax unless stated otherwise.

  • Prices are subject to change without notice, but confirmed orders will honor the price agreed upon at the time of purchase.

4. Bulk Beef Orders (Half and Whole)

  • Bulk orders typically require a non-refundable deposit to reserve your share of an animal.

  • Hanging weight and final cut weight will vary by animal; final pricing is based on actual hanging or packaged weight as applicable.

  • Customers may be asked to select a cutting sheet with processing preferences. Once submitted to the processor, cutting instructions generally cannot be changed.

  • Processing is handled by a third-party USDA-inspected or custom-exempt facility, as applicable. We are not responsible for processor delays, errors, or scheduling changes beyond our control.

5. Pickup and Delivery

  • Pickup location, dates, and times will be communicated directly to you and must be honored within the scheduled window. Extended failure to retrieve an order may result in forfeiture without refund, at our discretion.

  • If delivery is offered, delivery windows are estimates. We are not liable for delays due to weather, road conditions, or other circumstances beyond our control.

  • All products are perishable. You are responsible for having adequate freezer or refrigeration space ready at the time of pickup or delivery.

6. Quality and Food Safety

  • Our beef is raised and handled with care, but as with all raw meat products, proper storage, thawing, and cooking is the customer's responsibility. We recommend following USDA food safety guidelines for handling raw beef.

  • Please inspect products upon pickup or delivery. Report any quality concerns within [X] days of receipt so we can address them appropriately.

  • Nieslanik Beef is not liable for illness or injury resulting from improper storage, handling, thawing, or cooking of our products after they leave our possession.

7. Returns, Refunds, and Cancellations

  • Due to the perishable nature of our products, all sales are generally final once product has been picked up or delivered.

  • Deposits for bulk/bundle orders are non-refundable once an animal has been scheduled for processing, except at our discretion.

  • If you receive a damaged, spoiled, or incorrect product due to our error, contact us promptly so we can make it right through a replacement, credit, or refund, as appropriate.

8. Farm Visits and On-Site Activities

If you visit our ranch for pickup, tours, or events:

  • You do so at your own risk. Working farms involve inherent hazards, including uneven terrain, animals, and equipment.

  • Children and pets must be supervised at all times.

  • We reserve the right to restrict access to certain areas of the property for safety and security reasons.

9. Intellectual Property

All content on our website — including text, photos, logos, and branding — is the property of Nieslanik Beef and may not be reproduced or used without our prior written permission.

10. Limitation of Liability

To the fullest extent permitted by law, Nieslanik Beef shall not be liable for any indirect, incidental, or consequential damages arising from your purchase or use of our products or services. Our total liability for any claim shall not exceed the amount paid for the product in question.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Garfield County, Colorado.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
